1. ACCEPTANCE OF TERMS

By accessing, browsing, or using this website and our services, including our subscription services powered by Appstle, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please discontinue use immediately.

3. SUBSCRIPTION SERVICES

3.1 Subscription Plans

We offer various subscription plans through Appstle Subscriptions, including:

Pay-as recurring billing

Prepaid subscriptions (one-time and auto-renewing)

Build-a-box and bundling options

Free trial offers where applicable

 

3.2 Billing and Payment Terms

Subscription Fees: All subscription fees are clearly displayed at the time of purchase and are charged in advance for the applicable subscription period

 

Payment Methods: We accept payment methods supported by Shopify's subscription API, including Shopify Payments, PayPal Express, Stripe, Authorize.net, and Adyen you cancel your subscription, it will automatically renew at the end of each billing cycle at the then-current subscription rate

Payment Processing: All payments are processed through Shopify's secure payment system in compliance with PCI DSS standards

Failed Payments: If payment fails, we will attempt to process payment for up to three business days. Continued payment failures may result in subscription suspension

 

3.3 Subscription Management

Customer Portal: You can manage your subscription through our customer portal powered by Appstle, including updating payment methods, skipping deliveries, and viewing order history

Modifications: You may modify your subscription plan, delivery frequency, or products through your customer portal, subject to availability

Inventory: Subscription orders are subject to product availability. We reserve the right to substitute similar products when necessary

 

3.4 Cancellation and Refunds

For US Customers:

You may cancel your subscription at any time through your customer portal or by contacting customer service

Cancellations take effect at the end of your current billing cycle unless otherwise specified

Prepaid subscriptions: Refunds for unused portions may be provided at our discretion, subject to our refund policy

No refunds for partially used billing periods except where required by applicable state law

For Canadian Customers:

You have the right to cancel your subscription within 15 days of purchase and receive a full refund in accordance with Canadian consumer protection legislation

For cancellations after 15 days, refunds for unused portions may be provided at our discretion

You may cancel at any time through your customer portal or by contacting customer service

 

3.5 Free Trials

Free trial periods, when offered, allow you to test our subscription service without charge

You must provide valid payment information to start a free trial

If you do not cancel before the trial period ends, you will be automatically charged for your chosen subscription plan

You may cancel during the trial period to avoid charges

 

4. PRODUCT DESCRIPTIONS AND PRICING

We strive to provide accurate descriptions and pricing for all products and subscription plans. However, we reserve the right to correct errors and update information without prior notice. All prices initially listed in USD, but may be shown in local currency instead, and are subject to change with appropriate notice to subscribers.

 

5. SHIPPING AND DELIVERY

Subscription Deliveries: Products are shipped according to your selected delivery frequency and shipping preferences

Delivery Estimates: Delivery times are estimates and not guaranteed

Shipping Costs: Subscription shipping may be included in your plan or charged separately as disclosed at signup

Address Changes: You may update your shipping address through your customer portal

 

6. RETURNS AND EXCHANGES

For US Customers:

Return policies vary by product type and are disclosed at the time of purchase

Subscription box items may have different return policies than one-time purchases

Return window: 30 days from delivery

Refund processing time: 5 business days

For Canadian Customers:

Returns are accepted in accordance with applicable provincial Consumer Protection Acts

You may return products within 30 days of receiving your order

Subscription products follow the same return policy as one-time purchases

Refunds will be processed within 5 business days

 

7. PRIVACY AND DATA PROTECTION

For US Customers:

For Canadian Customers:

Anti-Spam Compliance (Canada):

8. THIRD-PARTY SERVICES

Our subscription services are powered by Appstle Inc., a third-party Shopify application. By using our subscription services, you also agree to comply with Appstle's terms of service. Appstle processes subscription data in accordance with their privacy policy and Shopify's data handling requirements.

 

9. INTELLECTUAL PROPERTY

All content on this website, including text, graphics, logos, and software, is our property or that of our licensors and is protected by copyright and trademark laws.

 

10. USER ACCOUNTS AND RESPONSIBILITIES

You are responsible for maintaining the confidentiality of your account credentials

You must provide accurate and complete information when creating subscription accounts

You are responsible for all activities that occur under your account

You must be at least 18 years old to create a subscription account

 

11. LIMITATION OF LIABILITY

For US Customers:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR SERVICES OR SUBSCRIPTION PLANS.

For Canadian Customers:

Our liability is limited to the maximum extent permitted by Canadian law and applicable provincial consumer protection legislation. Nothing in these terms limits your rights under consumer protection legislation.

 

12. DISPUTE RESOLUTION

For US Customers:

Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of Washington or Texas, except where prohibited by law.

For Canadian Customers:

Disputes will be resolved in accordance with applicable federal laws. Nothing in these terms limits your rights under consumer protection legislation.

 

13. GOVERNING LAW

For US Customers:

These terms are governed by the laws of Texas without regard to conflict of law principles.

For Canadian Customers:

These terms are governed by applicable federal laws of Canada.

 

14. FORCE MAJEURE

Neither party shall be liable for any delay or failure to perform due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or government regulations.

 

15. SEVERABILITY

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

 

16. MODIFICATIONS

We reserve the right to modify these terms at any time. Material changes will be communicated via email or website notice with at least 30 days' advance notice for subscription customers. Continued use of our services after changes constitutes acceptance of the modified terms.
